(45,588 posts)The NY Supreme Court in Rockland County -- the trial level court -- did not order a hand recount following discovery. It ordered discovery in a case that is seeking a hand recount. Step back and think about it logically. If the plaintiffs are seeking a hand recount and the court has ordered it, what exactly would be the point of discovery?
As any lawyer will tell you -- discovery comes first, and then a decision on a complaint -- not the other way around.
Will the court order a hand recount after a trial? Could be, but don't hold your breath, if for no other reason that discovery isn't going go be completed until seven months from now meaning in early 2026 and the case wouldn't go to trial for another month after that.
