They couldn’t be charged with impersonating a law enforcement officer, since (just like ICE) they aren’t wearing a uniform or flashing an ID or a badge.

Of course, if caught, the government will probably charge them with interfering with law enforcement, even if they say nothing and are just walking around. Law enforcement can be bastards that way.
