The impact in terms of whether he can be held accountable is similar, since the jury was empaneled and jeopardy had attached (meaning it would be double jeopardy for a non-MAGA prosecutor to undo the damage later.

But the former means a stupid person without the direct ability to send him to jail made an assinine decision.

The later means either a judge or jury evaluated all of the evidence, and found that that there wasn't enough evidence to conclude he violated the law.
