I realize that French law is different from the common law, but what it suggests is that truth doesn't matter in a libel action in France. Here in the US or in England, the truth would be a defense, even if Karsenty had not known of the rushes when he made his claim. They would still be admitted to show that his claim was true. Why were the rushes not admissible? Is there someone who is familiar with French law who could explain this?
