"If Senator John Kerry had won the 2004 election, Chief Justice Roberts and Justice Samuel Alito Jr., conservatives who have led the court to the right, would not be on the court. And last year’s devastating 5-to-4 ruling in the Citizens United case would likely not have happened."

1. Both sides feel this way
Conservatives think that is equally important for them to get the Supreme Court justices they want.
So maybe as a election issue, the sides sort of cancel each other out.

However, it is a very good thing to remind pouty people on the left about this critical fact. Maybe it will at least get them to the polls to vote for a Democrat. But I doubt it.

2. I was recently down at
#Occupy Wall Street where a girl describing herself as an anarchist told me she doesn't think it matters who is on the supreme court. Seriously!?! Some people just don't understand how fucking serious this is!

3. Well, no one ever said
that all the people who come to OWS are smart or even basically informed. The "it doesn't matter" crowd is totally devoid of critical thinking skills. I was distressed to watch this video that TPM put up of their reporter getting quotes from an OWS crowd in Chicago. Makes you want to slap yourself upside the head at points. I'm sorry, but they really do need some leader-level spokespeople to dispel the notion that a bunch of pumpkin heads are driving this movement. http://talkingpointsmemo.com/archives/2011/10/occupy_chicago.php?ref=fpblg
