About Proposition 8 in California

that would change the California Constitution to ban gay marriage:

Yesterday on CNN (cannot find the link) someone said that the California Supreme Court invalidated an earlier rule banning it based on the Federal Constitution assuring equal treatment under the law.

Thus, the commentator said, if 8 passes, it would remove rights from a group of people and wondered whether it would still stand.

Anyone knows anything?

1. it's REALLY about enforcing the christian religion on EVERYBODY in California

because the reason people have to be against gay marriage is all based on their christian religion, with the exception of some other religions like jewish, muslim etc, who believe gay marriage is a violation of THEIR own religions.

7. I just posted on a board dominated by conservatives

and when I posted something like my OP, someone, of course, asked me whether I would then approve of polygamy and incest.

My reply was that polygamy is not between two consenting adults.

As for incest, I stuck my head and said that if two siblings or a parent and a child are consenting adults then who are we to say no?

I don't know if I will dare go back and see what kind of fires they are throwing at me..

8. I've always asked the "pro pro-8" people "What is marriage?"

Is it about the sex, or is it about the lifetime commitment?

If all marriage is about is sex, then the idea of "sanctity of marriage" is definitely in trouble.
Prop 8 would then only be legalized sex contracts. It's all about de-legitimizing free will to having a legal partnership based on anything other than the type of sex one has. The next step is insuring that the value of people is reduced to having sex at the right time - like breeding show animals.

If marriage is about a lifetime commitment between consenting adults, whether or not sex or children are involved, then why the fuck would these hypocritical "sanctity of marriage" freaks vote for Prop 8?

3. Proposition 22 (the earlier 'defense' of marriage law) was overturned

because it violated the state constitution. Prop 8 would amend the state constitution, so it would not be subject to judicial review in the same way. Whether it violated the US Constitution would be a question for the USSC...

4. That's incorrect.

The court mandated marriage equality based on the equal protections clause of the state not federal constitution. And if 8 passes, there would be some question as to which takes precedence.

Of course state Constitution mandates equal protection so I can see the clashing clauses.

It may have to go all the way to the Supreme Court and by the we should have two new Obama appointees.

6. I don't think so.

I don't think it's going to ever be a federal issue. Prop 8 could be ruled invalid for being a constitutional revision rather than a mere amendment. This would have required a convention to pass it. The state court deferred addressing this until after the election if it passes.

I'm in Boston and we are closely watching it...we don't want to be the only 'gay state'...the ball is rolling down hill with civil unions, now gay marriage in 3 states (ct just joined the club for now) don't let the ball be stopped in its tracks out in CA!!!

America, (esp. UTAH) you seriously need to grow up. You would rather have children suffer being abandoned by society than live in loving homes. Who is the perverted one now?
This is an abomination.

We are your children, your parents, your grandparents, and your grand children. We are your aunts, uncles, nephews, and nieces. Some of us raise children; some children are our own, some are other's children (i.e. - abandoned).

Having the LOVE-orientation to fall in love with the same gender is AS SACRED AS any heterosexual love. Period.

And I will continue advocating EQUALITY TAX REVOLT until the law catches up with morality and common decency!

the youth is largely pro-gay marriage. Just look at the large change we had in 8 years since the last vote.
