I spoke to a client who used to work on the Hill for the republicans and who is still very well connected. He doesn't think either side is certain of their vote count. He feels that several repub senators are concerned that Frist has allowed himself to get hi-jacked by extreme interests who are saying "no compromise" and that Frist needs to figure a way out. The same analysis, to a degree, applies on the Dem side as well.

The analysis for the Democrats is similar to that facing the repubs in that they don't know if they have the votes and there are concerns that a "no compromise" position could come back to bite the Democrats if they lose the filibuster now and are unable to block an extreme Supreme Court nominee. The feeling is that the reason the repubs have decided to have the filibuster fight now is that they don't want to have it in the context of a Supreme Court nomination where more people will be paying attention.

it's time to have a full vote and if the filibuster is lost, the fight must begin. Democrats must decide when and where to have this fight, not the repugs. If a deal is made now, can we trust the issue will not surface again? I think not.
