Has anyone been fired for this?

My husband was laid off from his job recently. When he went for unemployment, his former employer said he was fired because he argued with management about something "against company interest".

Here's what happened. He was a mechanic at an auto dealership, on straight commission, which meant he only got paid if he worked. He diagnosed a job and sold it-and management gave the job to a straight time oil change boy making $7 an hour. My husband questioned this, and asked if he wasn't at least going to get paid for diagnosing. At the end of the day, they told him yes, but that they didn't need him any more.

My question is this-isn't questioning why you are snookered out of work you diagnosed and sold arguing for your personal interest? Or does only 'company interest' count? Even if the 'company interest' is to shaft customers by making them believe their car is being serviced by a master mechanic when it isn't - and charging the customer the same price?

I put this in the Arkansas section because I figure that employment laws are specific for this state, and I'm wondering how pro-business Arkansas really is.

Yes, he's appealing the ruling.

1. I feel this need to share with you my husbands story and how his company
denied him unemployment.

He was the Network Administrator for a telecommunications company. His immediate boss and the boss above him were sending pictures of nude women, racial jokes, and sex jokes to several members of the IT department. My husband included. Well, my husband feared that he could be held accountable (since he was in charge of all the email accounts, servers, etc) if he knew this was going on and didn't address the issue with the appropriate management. So, he took the emails to the VP of the company and THEY DEMOTED HIM and didn't give him his raise! My husband took issue with that and they put an ad in the paper for his job! He sent them an email stating that he would like these issues to be addressed or he would resign. They walked in and escorted him out the door. They told unemployment that he resigned and was unable to collect unemployment.

Needless to say, he got an attorney and filed charges with the Department of Human Rights and obtained Right to Sue from the EEOC based on sexual harassment, retaliation and constructive discharge.

The things company's will do not to pay unemployment are beyond my comprehension.

It sounds like your husband got screwed and for that I can totally relate! I am sorry because you will have an uphill battle.

2. Some years ago I too was fired.
It was ugly, it was personal. I lost the arbitration. But it was a good thing. I got a much better job with a much better company.

There's nothing wrong with seeking justice, but if it takes on a life of its own..... Justice may come in a different form than you might wish or expect.

If this is your Husband's way of doing things, it would seem to me that he should look for a better employer, one where his work ethic is appreciated.

Anyway, that's what I learned from it.
