"Baby dies after being attacked, thrown from car"

TAMPA, Fla. – A 21-year-old man was charged with first-degree murder Tuesday after police said he snatched up his ex-girlfriend's 3-month-old son during a fight and then threw the baby from his car on an interstate highway.

The child's lifeless body was found near Interstate 275 north of downtown Tampa early Tuesday. The man, Richard A. McTear Jr., was captured several hours later. Deputies said he is not the child's father.

The Hillsborough County Sheriff's Office said McTear was arguing with his 17-year-old ex-girlfriend, Jasmine Bedwell, at her apartment when he began beating her and the child. She reported that McTear threw her son, Emanuel Wesley Murray, down on the concrete, then picked him up and fled in his Chevrolet Impala.

Jason Bird, a news photographer for WTVT-TV in Tampa, spotted the baby's body on his way to work at about 4:30 a.m.

7. Rehab is not the reason for incarceration -

that's a latter-day trend that, while I applaud it, was not originally behind the idea of the sentences.

They're called "penitentiaries" for a reason. That's why, and I'm not terribly proud of this, but, in my legal life I encountered some folks - I hesitate to call them "people," which has far too human a connotation - who need to be left alone in a cell for the rest of their lives. There is nothing else that can be done with them. Stone walls, floor, ceiling, solid metal locked door. That is what they cry for, that is what they must have.

Penitence. Perhaps they will someday understand and embrace it. But, in the meantime, they must be put away. Far away .....................

Pa. judge sets bond for mom who swung baby

ERIE, Pa. – A Pennsylvania judge has set bond at $20,000 cash for a woman appealing her conviction for swinging her infant at her boyfriend during a fight in 2006.

Erie County Judge William Cunningham set bond Tuesday for Chytoria Graham. She was sentenced in 2007 to up to 10 years in prison for aggravated assault and other charges. She is appealing her conviction and sentence to the Pennsylvania Superior Court.

Graham is claiming in her appeal that the public defenders who represented her at trial were ineffective.

Graham confessed to police that she swung her son like a baseball bat and hit her boyfriend with the baby. The baby has recovered from a fractured skull suffered during the fight in October 2006.

to some people. They think nothing of the consequences of their decisions, live only in the moment and do whatever seems ok to them at the time. Then they turn around and blame others for their bad decisions.

He not only slammed the baby on the ground but he threw him out the window of the car like some people throw out the trash or the butt of a cigarette.

with conflicts over the death penalty. There's no question that people like this murderer deserve to die. We can oppose the penalty because there is no one we trust to make the decision correctly every single time.
