Landlord Faces Misdemeanor Assault Charge for Allegedly Raising Tenant's Heat on Hot Day

CAPE GIRARDEAU, Mo. Sep 3, 2005 — A landlord faces a misdemeanor assault charge, accused of turning on the heat in an asthmatic tenant's apartment this summer after a dispute over unpaid rent and living conditions.
Fred Barnard, 62, of Cape Girardeau, will next appear in court Sept. 26.
Cape Girardeau police said they recorded a temperature of 125 degrees in the apartment of tenant Denise Owens.

She claimed to police that Barnard then raised the heat and left. This was allegedly done "on a very hot day knowing that her air conditioner was not working and that she suffered from asthma," according to court records.
Barnard then refused to come to the apartment when patrolman Rob Watson called to ask him to turn off the heat.
