Be wary of anyone asking you to sign an initiative petition
on "Save Our Secret Ballot."
Although supporters claim it's about saving your secret ballot, go to their website at www.sosballot.org and it's clear that their real goal is to kill the Employee Free Choice Act (EFCA).
Introduced in the U.S. Congress earlier this year, EFCA would remove unfair barriers to union representation and collective bargaining so that employees can get their fair share.
The first part of the Save Our Secret (SOS) Ballot initiative petition reads: "Shall the Missouri Constitution be amended to: Restate the existing statutory guarantee of a secret ballot in federal, state, and local elections. . .?"
There's no need for a constitutional amendment on your secret ballot in federal, state, and local elections - you've already got that guarantee.
The second part of this initiative petition reads: "Shall the Missouri Constitution be amended to: Change the current law relating to employees organizing for union or other representation by eliminating the ability of employees to use the existing sign up process to choose such representation and only allowing a secret ballot election?"
What supporters of Save Our Secret Ballot really want is requiring secret ballot elections for Union representation even when the majority of employees have already signed authorization cards.
If Congress passes the Employee Free Choice Act, it would level the playing field by certifying Union representation once a majority of employees (covered under the National Labor Relations Act) sign authorization cards.
* Under current law, even if a majority of employees sign authorization cards for Union representation, the employers can demand a secret ballot election. * And it's documented that employers often prolong these Union organizing elections, while intimidating and even firing employees who want to form the Union.
While the Employee Free Choice Act provides fairness to employees in the workplace, Save Our Secret (SOS) Ballot does not!
