Judge Jeffrey Manning, during a hearing on pretrial motions, also refused Ms. Orie's request to disqualify the county district attorney's office from prosecuting her. Ms. Orie is accused of using legislative staff and resources for political purposes.
The DA had asked for a jury from a different county, but Ms. Orie opposed it. The judge, however, said he would exclude residents of Ms. Orie's senatorial district.
Ms. Orie also had alleged the DA had animosity toward her and should be removed from the case, but Judge Manning rejected that.
He also issued a gag order in the case.
