"Va Won't Join Brief In Funeral Protest Case"

RICHMOND, Va. (AP) - Virginia will not join other states in filing a friend-of-the-court brief in the U.S. Supreme Court supporting the father of a Marine whose funeral drew anti-gay protesters carrying inflammatory signs.

Attorney General Ken Cuccinelli announced the decision Tuesday, citing concerns about freedom of expression.

A jury in Baltimore awarded Albert Snyder $5 million in damages after protesters from the fundamentalist Westboro Baptist Church picketed his son's funeral. The protesters carried signs with messages like "Thank God for dead soldiers."

A federal appeals court in Richmond threw out the verdict, saying the signs contained rhetoric protected by the First Amendment. The Supreme Court has agreed to hear Phelps' appeal.
