Just read in the Gazette that Joe Lovett and the Ohio Valley Environmental Coalition won their lawsuit challenging the Army Corps' use of a single nationwide permit to allow valley fills associated with mountaintop removal. To use a nationwide permit, there has to be minimal cumulative impact on the environment. It has always been a joke that the feds used this permit for MTR. But Judge Goodwin has put a stop to it! I have a good feeling about this decision (i.e. that it will stand up on the inevitable appeal to the 4th Circuit).
But I guess we should get ready for "the sky is falling" reports from the coal companies.
Plus, though this is great news, is it bad timing? Could this hurt Kerry and bolster Bush in the coalfields?
