A judge has rejected Kanawha County Prosecuting Attorney Bill Charnock’s assertion that Mezzatesta is immune from prosecution in Hampshire County.
Hampshire Circuit Judge Donald Cookman has appointed a special prosecutor to determine whether Mezzatesta lied in an affidavit that he gave to the state Ethics Commission last year. The Ethics Commission cleared Mezzatesta of wrongdoing last June, but later reopened its investigation.
