10th Amendment & Abortions |

i was arguing with a pro-lifer who claims that the ruling of roe v. wade was unconstitutional because it violated the 10th amendment which he claims allows the states the prohibit/legalize abortion because, according to him, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively".
my response was that other people have no right to dictate how females treat their bodies.
how should i respond to his claim that the 10th amendment should allow states to legalize/prohibit abortions?

(The Court that ruled on it, of course, not today's silly right wing bunch.) If memory serves, and it doesn't always serve me very well anymore....the rights of the individual American citizen (ie. Mz. Roe) as outlined in the Constitution and its amendments trump the state's rights argument. I THINK your prolifer friend might stretch his argument to include (for example) Mississippi's (insert state name here) right to re-institute slavery or mandate a particular religion. I'm sure many DUers who know this subject better than I will jump in here. Check out the Court's ruling on Roe v Wade. The arguments should all be there.

Abortion is murder. Unless the pregnant woman is raped, in which case rape is a greater evil than murder.
As for the rest of your post, perhaps you should talk to some women who have had abortions. Listen to their stories, listen to them.

" No, it has remained legal because it is a medical procedure between a woman and her doctor as well as preventing dead women. Women died due to unhygienic illegal abortions. Part of it remaining legal is that they don't any more. Part of it remaining legal is that if you had money and/or power, you always were able to get a hygienic safe abortion. It was those who were not rich or powerful who died from illegal back alley ones. The right to an abortion remains not to "divide and conquer" but to equalize that right irregardless of how rich or poor you are. And to save women's lives.
I guess you don't care about living women's lives though, just those "unborn babies". Unless the woman was raped. In which case the murder is fine.
