The Senate voted for the measure in the last few hours.
Now, the bill will be approved by Nigeria's House of Representatives, before President Goodluck Jonathan formally makes it law.
The proposed law received substantial backing by the public, with many wanting tougher sentences.
According to the Associated Press, couples who marry could face up to 14 years in jail, and witnesses or anyone who helps couples marry could be sentenced to 10 years.
Homosexuality is illegal throughout Nigeria, with some parts using the death sentence as punishment.
