I have a friend who is being harrassed at work because of disabilities. Just some details to help explain:
individual has worked at facility for 19 years
individual has had "restrictions" from a doctor for many years.
individual recently had surgery for a condition NOT connected to the disability which required the "restrictions".
Individual came back to work to find that the job description had been changed to require the holder of the position to do work that is a no-no in the restrictions. Basically, the employer is saying that since the surgery, everything should be fixed. But the surgery did NOT fix the disabilities the "restrictions" were aimed at.
Anybody have any advice????

You start throwing the ADA laws around and employers get very very nervous. Learn them inside and out so that you can start spewing the ADA law around at the job. Especially if your friend works at a large company. Shame on them. They should know better. They are apparently trying to get her to quit her job. Tell her/him to hang in there. There are laws that protect those of us with disabilities and still can hold down a job. Shame Shame Shame

I don't know the law there but there are federal laws involved here, get an attorney involved immediately....

This is what I told this individual, but they are so strapped with bills that they are afraid they cannot afford an attorney. There are few resources in our area to help people with attorneys and such. But, froim my reading of ADA, they have a definite case. To make matters even more sinister......a medical facility is breaking ADA!

An attorney of some sort, many will give an initial consult for no or little cost and if they have a strong case for some damages take it on a contingency basis. But I would also contact the ACLU and see if they will get involved.

Uncertain what nation you live in. If you are living in the US could your friend see a lawyer specializing in disabled people. I know in Phila, PA there are law groups that deal exclusively with persons with disabilities. Plus the Americans with Disability Act. Don't know where you live so I can't tell what options exist. Good luck with getting help.
