DENVER — Colorado has appealed a federal court ruling that limited the state’s ability to regulate the destruction of obsolete chemical weapons stored outside Pueblo.
The state filed suit in 2008 hoping to require that the Army meet a congressional deadline to destroy about 2,600 tons of mustard agent stored at the Pueblo Chemical Depot by 2017.
A judge ruled last September that federal law limits the state’s authority to set timelines and deadlines for destroying the mustard agent.
State officials appealed to the 10th U.S. Circuit Court of Appeals last month.
A telephone conference is scheduled for Jan. 19 to discuss whether a settlement is possible.
