Defendant/husb didn't show at 'scheduling' conference, |

for separation agreement. 2 dates set, Nov for 'repeat,' Dec for alimony pending litigation. Damn this. Thinking of suing him outright for divorce, with cause.

Can he continue not to show without being cited?
Sorry you have to go through this.

Might result in a 'default' finding (in my behalf, of course.) Will find out what we can do.
Thanks

3. I know what it's like. |

My ex NEVER attended a hearing or meeting with attorneys on the first date set. I am so sorry that I did not move more quickly to file for divorce, as my waiting for him to be "ready" allowed him to get a second attorney, one who is far more cut-throat and as a consequence I did not get the financial settlement I'm convinced I would have gotten had I filed sooner.
Just last month a hearing was scheduled as he's trying to permanently reduce or eliminate support to me. I took three days off work without pay to drive the 850 miles each way for this. I had not been able to attend two earlier hearings because of the distance. I was two hours on the road when I got a call from my attorney telling me they'd asked for a continuance because Ex has a bad back these days and apparently could not get out of bed.
Luckily for him I was still about six hundred miles away. Sometimes I'm amazed that the murder rate isn't a lot higher than it is.

I can't imagine what I would do if so far away, in these circumstances. We're both attorneys and at the moment he hasn't hired one, thinks he can do it on his own. The pleading he filed was, imo, so badly done that I think he's well on the way to making case for me; his lies were incredibly pervasive.
Am frustrated, tho, that next hearing isn't until November, and alimony hearing is December. Won't be able to afford decent gifts for our daughters, as well as adequate funds for my attorney to do the research he has to do.
As to the murder rate, may should be 'self defense.'

Husb complained of new 'scheduling' hearing set by judge, for Nov. 19. We responded to his objection, waiting for judge's decision.
Alimony hearing set for mid-Dec., and I'm really frustrated this is taking so long. I fully expect husb to object to everything, and getting more and more angry.
PS, what happened to all the Groups????
