There is already a system in place to deter lawyers from filing frivolous laws suits or non-colorable claims. It's called summary judgment. Also, an attorney can be sanctioned by the court for filling non-colorable claims. It's called vexatious litigation.

Like if the RIAA gives me an offer when I did nothing wrong? I can give them $1000 to go away, or I can pay a lawyer many times that to go to court. They may not threaten thousands of people when they have insufficient evidence if all of those people could get a $10,000+ lawyer that they may have to pay.

7. Both your claims are misleading.

It can easily cost a company 100k in legal bills even if a case does not go to trial and they get a summary judgment. You may not find a problem with that but most do. Yes I know about sanctions. But it almost never happens despite hundreds of thousands of suits being dismissed every year.
