1. Calling the language in the 2nd Amendment about the militia surplusage

was contrary all principles of interpretation of legal documents, like statutes and contracts.

We took our earliest laws from the laws of England, during the reign of Queen Elizabeth I. At that time and for many years before that, the rule was that you do not interpret any language in a statute as having no legal effect. You never assume a legal document has extra words that were meaninglesss.

How much more so would that apply in the Constitution, where the Framers used very few words in the blueprint for governing an entire nation.

Scalia should be impeached for making up whatever he wants as an outcome, then claiming he is applying originalism. He is not. He is applying his own power trip. He is one very dishonest man. I have no idea why Judge Ginsburg is his friend.
