11. It hasn't gone away yet
There has to be a resolution with the House, which is slightly on Bush's side on this, plus Bush has threatened a veto if he gets a bill that denies the Dept of Labor from going ahead with the rules.

So we don't have to wait until after any election to hear more about this. The Repugs may well want to push it off until then, though,for the reason you mentioned.
