39. Impeachment
Congress's legal recourse against a president is called impeachment. Acting beyond Constitutional authority is an example of a "high crime or misdemeanor". There's really no intermediate here. You could censure the president, but this one won't respond to that. The administration is banking on the fact that Congress won't impeach him and he keeps pushing the line. Talking tough about lawsuits does nothing. Courts are not going to answer this question. This is something that the Supreme Court would have original jurisdiction over and there is no doubt that they would declare any lawsuit void on the basis of the "political question doctrine" enunciated in Baker v. Carr.
