"The California Hospital Association today plans to file an appeal and request for an immediate stay of a state court ruling earlier this month that reinstated a mandatory 1:5 nurse-to-patient staffing ratio for hospital medical-surgical units in the state. If approved, a stay would allow hospitals to return to the law's original 1:6 ratio until the Third District Court of Appeals hears the case. A Sacramento Superior Court Judge ruled March 4 that the California Department of Health Services overstepped its authority in issuing emergency regulations last November to suspend the 1:5 ratio. CHA says the lower ratio would force hospitals to choose between closing beds and eliminating patient care services by requiring an additional 4,000 nurses at a time when California hospitals already have 14,000 vacant positions. The state also filed an appeal of the court decision yesterday."
