That enough votes that would have been cast were lost via various methods of voter suppression that a Kerry win was turned to a Bush win in Ohio. He includes estimates for how many votes were lost due to not having enough machines - but the fact is that votes not cast are votes that can not be used in court. Unfortunately many of the techniques - as undemocratic as they were - were not specifically even illegal.
Now, Kerry and Feingold in 2006 wrote legislation requiring that polling places be supplied with paper ballots that would be counted as regular (not provisional) ballots that would be used when wait times for whatever reasons became too long. It was blocked by the Republicans, which the senators knew it would - there stated purpose was that it could be used as a model for state law. Kerry spoke of many problems in the Senate and in speeches.
