9. Well...yes,..he can. Recess appointments...
...have been used to place justices on the USSC before. They must be confirmed by the next congress but once a nominee is on the bench it seems as if it would be pretty hard to remove them. In fact, I don't know if a justice seated with a recess appointment has ever failed to be confirmed later.
