BAGHDAD, Iraq (AP) -- The NBC correspondent who filmed the fatal shooting by a Marine of an apparently injured and unarmed Iraqi by a U.S. Marine inside a Fallujah mosque has written on his Web site that the wounded man made no sudden movements before the Marine opened fire on him.

Before the opening of the Nov. 8 assault on the rebel-held city, Marine commanders told infantrymen that the rules of engagement allowed for use of deadly force against men of military age deemed holding hostile intent, even if the enemy didn't fire on the Marines first.

In a posting on his Web blog dated Sunday, Kevin Sites, a freelancer on assignment for NBC, wrote that he didn't see the wounded Iraqi make any movement before the Marine shot him -- but that only the Marine can explain his mental state before the shooting.

``Through my viewfinder I can see him (Marine) raise the muzzle of his rifle in the direction of the wounded Iraqi. There are no sudden movements, no reaching or lunging,'' Sites writes.

if conscious at all. It was replayed over and over unedited in the Arab media. It is way past time to bring the troops home, this is beyond FUBAR.

America should do away with -- get rid of -- courts-of-law! Why bother? Just toss it about via the the 24/7s talking-heads, or on on blogs and boards of the internet, then let the accused suffer the consequences, okay? Hell why not?! What fun.

It worked for Billy Jeff Clinton, correct? He was impeached by the news media, correct? Then the House got to smile into the teevee cameras, correct? Wow. What thrills, huh?

I just get soooooooooooooooooooooo damn tired of out-of-court crap. And it is crap too.

7. The BIG picture
is that the actions of this one Marine are an accurate analogy for American foreign policy in Iraq. The image has zip to do with this particular individual's right to "due process." If you recall, the entire nation of Iraq was DENIED due process prior to "Shock and Awe."
U.S. troops have been indiscriminately EXECUTING Iraqi citizens since March 2003. Film at 11.

knows what happened in that room except those who were there as so-called "eye-witnesses" and even at that, there are different and varied perceptions of "eye-witnesses" due to a variety of rationalities.

Conjecture, speculation, and broad-statements make a mockery of our constitution and its trial-by-a-jury-of-your-peers guarantee. I need not add anything more than what I've already stated in this post and in my prior post in this thread.

13. The reporter WAS an eyewitness...
...and related his first-person account in this article. He said he didn't see the Iraqi make any moves before the Marine discharged his weapon into him. His videotape of the incident supports his assertion 100%.

Those are the facts. No conjecture, no speculation...

As far as the Marine's state-of-mind when this took place - the Marine is a highly-trained professional who should always follow procedure. The fact that he didn't follow procedure means he should be prosecuted or hospitalized - i.e. he needs to be taken out of the game for good, before he does this again.

I thought the guy WAS dead the first time I saw it. He was unconscious. If that isn't a war crime, I don't know what is.
