Taxpayers to pay for Janklow accident


SIOUX FALLS, S.D., Dec. 1 (UPI) -- Taxpayers, not former South Dakota Rep. Bill Janklow, will pay for a fatal traffic accident involving Janklow because the lawmaker was on duty at the time.

A lawyer representing relatives of Randy Scott, the Minnesota man killed in the mishap. Says the family will not contest a federal judge's ruling that Janklow was on duty Aug. 16, 2003, when he sped through a stop sign near Trent, the Sioux Falls Argus reported Wednesday.

Under the ruling, Janklow is covered by the Federal Tort Claims Act, which protects federal employees from negligence claims while they're on duty.

"I was primarily concerned about the statute of limitations," said Minneapolis lawyer Ronald Meshbesher, who represented Scott's family.

2. Is Janklow willing to die clean?
Will he do what is proper and pay the fine himself or will he let the citizens pay for his mistakes again? His mistakes have already cost somebody their life, now this will hit their wallet. Does he have the character to pay this from his own pocket? Is he willing to die clean of his trespasses on the citizens of South Dakota? This is truly a test of Janklow VALUES! There is that word again in reference to a repug action. Nixon-values, Janklow-values, Ryan-values, Delay-values, etc....

4. Accident?
How is speeding through a stop sign an accident?

Was he slowing down for the stop sign, and then his foot accidentally slipped and the car accelerated? It was not an accident. Janklow was deliberately ignoring the law when he hit the other person. Ignoring the law is not in the line of duty.

6. Damned right. The line of duty would refer to legitimate circumstances.

It shouldn't be forced to cover ANYTHING which can happen during his work hours or while he is allegedly doing business related to his job in Congress.

Why hasn't someone in his state government made a point of this? They'd make big points with some very angry taxpayers if they did.

The charges could have carried as much as 10 years in prison.


If Janklow completes his probation without incident, the conviction will be removed from his record. Steele also said that after serving the first 30 days of his sentence, Janklow will be allowed to leave jail periodically to perform community service.

he ran a stop sign at a rural intersection about 10 miles south of Flandreau

was going at least 70 mph in a 55 mph zone at the time of the collision.
