Media Challenges Army Decision on Hearing
DENVER - An attorney for The Denver Post on Friday challenged the Army's decision to close a hearing on whether three soldiers should be tried for murder in the death of an Iraqi prisoner.


Newspaper attorney Steve Zansberg said a petition was filed with the Army Court of Appeals in Washington seeking to make the hearing public except for the presentation of classified material.


On Thursday, an Army investigating officer closed the hearing to the public, citing national security.


The three soldiers are charged with murder and dereliction of duty in the death of Iraqi Air Force Maj. Gen. Abed Hamed Mowhoush, who investigators say was suffocated during an interrogation last year.

And the Bryant case won't go to trial. He'll settle out of court.

7. UPDATE: Army Murder Hearing Halted Over Access
DENVER — An Army appeals court stopped a hearing Friday for soldiers charged with killing an Iraqi general during an interrogation and ordered the military to explain why the proceedings have been closed to the public.



The Army Court of Appeals granted an emergency stay sought by The Denver Post on the second day of the hearing at Ft. Carson, an Army post 70 miles south of Denver.


On Thursday, hearing officer Capt. Robert Ayers closed all of the proceedings to the public, citing national security. He also said publicity might jeopardize the safety of the defendants, some of whom were assigned to military intelligence units.


But the appeals court gave Ayers 10 days to show why nonclassified portions of the hearing should not be open.

8. I Need the Orwellian Definition of "National Security" Pls.
So our outgoing Health & Human Services Secretary can get up on TV and say "I can't for the life of me figure out why terrorists have not attacked our food supply because it's so easy," but a hearing into whether three solders who murdered a guy has to be closed for reasons of "national security." Not that I think the Secretary should not be allowed to say something so unspecific, but isn't there a difference between the strategic and the tactical here? Will it really give our enemies a great advantage if they find out how our soldiers murdered a somone? WTF does "national security" mean (aside from whatever its convenient to mean)?
