Court Sidesteps Cheney Ruling (Energy Task Force)

(CBS/AP) The Supreme Court refused Thursday to order the Bush administration to make public secret details of Vice President Dick Cheney's energy task force, but kept the case alive by sending it back to a lower court.

Justices said 7-2 that a lower court should consider whether a federal open government law could be used to get documents of the task force.

The decision extends the legal fight over the information. Justices could have allowed a judge to immediately move ahead with ordering the release of the papers.

"Special considerations applicable to the president and the vice president suggest that the courts should be sensitive to requests by the government" in such special appeals, Justice Anthony M. Kennedy wrote for the majority.

2. Oh, now the president and vice president deserve special consideration
That certainly wasn't the Court's position when it was a Democrat in the Oval Office. As I recall, they went 9-0 in favor of allowing the bullshit Lewinsky civil suit to proceed because back then nobody was supposed to be above the law.

But, as I recall, 9/11 changed everything.

My post is not a negative against you, gratuitous. It was just that you summed up what has occurred so succintly and I am so sad. It's like they use 9/11 as a magic shield for destroying our country - and it's so wrong.

And anyone who takes a post seriously made by some guy who posts under the handle "gratuitous" has more to struggle with than anything I could help them with. :hi:

It is disturbing to see the highly situational nature of the so-called eternal verities allegedly prized by the "moral" folks who see Simpleton W. Bush as a paragon of values and righteousness.
