Changes sought in rules on lunch breaks (by Schwarzenegger )

The Schwarzenegger administration is seeking an emergency rule that would weaken a Gov. Gray Davis-era law that protects the rights of workers to take lunch breaks.

The unusual move by the governor's labor officials is aimed, they say, at limiting lawsuits by employees against their employers and clearing up confusion among employers about their responsibility to provide breaks.

But critics of the order, including labor groups and some Democratic lawmakers, accuse Schwarzenegger of trying to undo a long-standing right to lunch periods that was strengthened by Davis in 2000 to allow employees ranging from farmworkers to bus drivers to sue employers who denied them breaks and recover years of lost wages.

"This is quite a Christmas present to employers,'' said Laura Ho, an Oakland attorney whose law firm sued home mortgage giant Countrywide Financial Corp. over workers' missed meal periods.

1. Heard the story on NPR this morning
apparantly, all an employer has to do is provide notice to the employee and have them sign it. Voila - you no longer need lunch.

lunch is an important meal. Not allowing a full lunch hour makes employees more prone to fucking up when they go back on. Bad for productivity.

19. How is he going to get around OSHA regs?
OSHA regs state that for every 6 hours a person works, they must be given a 30 minute meal break. That's federal law, I don't see how he can get around it.

21. Not to mention that nearly every union contract contains a provision
for at least a 30 minute lunch break as well as 15 minute morning and afternoon breaks as well. Groperman is in over his head but you all know that.

it's not about being able to take breaks. It's about the middle and lower classes ability to redress grievances. We are not so slowly losing that ability. We are being fucking steamrolled toward indentured servitude and we are not going to be able to stop it through use of the courts. That doesn't leave the masses many options.

OSHA (watch for Shrub to work on this. He's got another 4 years to try). The @$$hole Freeps and Rethugs have long whine about OSHA and "restrictive" laws that prevent corporations from maximizing profits. Bottom line for @$$holes is profits and portfolio fattening. F*** workers' rights and safety and f*** improving the livelihoods of Americans. That's their attitude.

35. I don't know about OSHA, but there is no Fed law that mandates lunch.
When I first read this thread, I thought the same thing, but all the sites I checked all said this was determined by State law! Most states mandate 30 minutes after 5 hours work, but it's up to the employer if they wish to make it longer, as some do.

I didn't check the OSHA regs, but most of them involve safety issues as far as I know.
