PHILADELPHIA - Police have arrested a soldier they say had his cousin shoot him so he wouldn't have to return to Iraq (news - web sites).



Army Spc. Marquise J. Roberts, of Hinesville, Ga., suffered a minor wound Tuesday to his left leg from a .22-caliber pistol, police said. He was treated at a hospital, then arrested after he and his cousin allegedly admitted making up a story about the shooting.


After giving differing accounts of the incident, "they just broke down and confessed that they concocted the whole story so he didn't have to go back to the war," Philadelphia police Lt. James Clark said Thursday.


Police charged Roberts with filing a false report and charged his cousin, Ronald Fuller, with aggravated assault and other charges.


Roberts, who was visiting family in Philadelphia, initially claimed he was shot during an attempted robbery, but Fuller had said the incident occurred at another location during an argument, according to Clark.

you'd think they would have gotten their story straight
before the shooting.

That said...yes, it's tragic that soldiers are driven to this...

2. I wonder what would have happened if the cousin just said he shot his
cousin to keep him out of Iraq, and the first cousin just kept his mouth shut.

I can't imagine that any prosecutor would try to convict of a crime (if that is even a crime).

Maybe it's a crime to shoot people to keep them out of the armed service. Who knows?

Is a prosecutor going to challenge that, especially if the cousin backed him up on it?

14. They'll put him under oath and he'll lie and they'll convict him of filing
a false police report and perjury.

If the one just tells the truth and the other exercises his fifth amendment rights and the shooter can say truthfully (or convincingly) that the shootee didn't ask to get shot, that's that.

However, I wouldn't be surprised if it's a federal offense to intentially injure a person in the armed forces preventing that person from serving. If it's not against the law, it should be.

3. Well, he still may be able to avoid going to Iraq
Of that will only be because he will be a felon and/or instead will be deployed to the Pennsylvania Corrections System or a military prison. His chances of survival there will probably be greater than in Iraq.

16. Quit the military? Yeah, right! If it was possible
to do that there would be damned few people in it. One tends to find out on day one what a horrible mistake one has made joining up. Been there, done that.
Except for lifers (and extendees) every single person knows exactly how many days they have left.
