Officials: Ohio Supreme Justice Fails Sobriety Test

COLUMBUS, Ohio -- A state Supreme Court justice was arrested and charged with operating a motor vehicle under the influence after several motorists called to report an erratic driver on an interstate.

Justice Alice Robie Resnick also was charged with driving outside marked lines, a minor misdemeanor.

Lt. Rick Zwayer, a State Highway Patrol spokesman, said Resnick, 65, of Toledo, was pulled over on I-75 south of Bowling Green. He said she failed field sobriety tests and was arrested at 2:02 p.m. Monday in Wood County in northwest Ohio.

Resnick could not be reached for comment last night, according to The Columbus Dispatch. Chris Davey, a spokesman for the Supreme Court, declined to comment.

Ohio Supreme Court Justice Alice Robie Resnick was charged with operating a motor vehicle while under the influence and driving outside marked lines yesterday in Wood County.

The 2:02 p.m. arrest by the State Highway Patrol followed several cellphone calls from motorists reporting an erratic driver on southbound I-75, according to Lt. Rick Zwayer, a patrol spokesman.

Resnick, 65, of Toledo, was pulled over near Rt. 6 south of Bowling Green, where she failed field sobriety tests, Zwayer said.

Resnick was taken to the patrol’s Findlay post, where she refused to take a test of her bloodalcohol content, Zwayer said. That led to the charge of operating under the influence, a firstdegree misdemeanor. The marked-lanes violation is a minor misdemeanor.

And one of the few decent judges on that court. In 2000 the Chamber Of Commerce waged a $4 million dollar anonymous campaign against her for voting against tort reform, limited liability, and school funding cases.

5. Makes you wonder - is this someone who would have been
supportive of any of the legal actions going on about the election fraud?

Hate to feel this paranoid, but my first thought is that KKKarl is making sure that nothing reaches the light of day - and if there are "liberal" judges who might be willing to allow a hearing or deposition or access to the machines code....well, it wouldn't be that hard to spend a few days watching anyone, just waiting for them to have a drink at dinner out at a restaurant or a party - then calling in the HP. Or in this case, at 2:02 pm, watching to see if someone had a drink with lunch.

Don't know the woman's size, but one glass of wine in a smaller framed person would certainly exceed the legal requirements for DUI.

not who she was. But, nevermind the facts......ROVE, ROVE, ROVE....he's everywhere!!! You know he is currently making the weather cold outside and I think he is keeping the local carryout from stocking my favorite beer. I think he is also making my lettuce wilt early and my milk to sour.

I mean, that is why she used the opportunity to vindicate herself by taking the Breathalyzer test. Oh, wait a minute, she refused the test and instead automatically took a 1 year suspension of her driving license. Yea, that sound innocent to me. DAMN YOU ROVE!!!!

40. Actually, I've read that if stopped for DUI you should
ask for a pre-arrest breath analyzer test, if you think you might be able to pass it. My understanding is this test is not admissible so if you fail you can then decline to be tested. But this was several years ago and laws change and are different in some locations.

Also from the same article was if you KNOW you are going to fail you should decline any tests and take the suspension. Your chance of beating the rap gets much better without that prove positive test hanging over your head.

My advise is TAKE A CAB DUMMY, or walk or get a hotel room but DON'T DRIVE DRUNK. Of course my advise may be worth the price paid.

One Drink . . . "It's as simple as A, B, C . . ."
A. "One drink" means:

12 ounces of beer, OR
9 ounces of wine cooler, OR
4 - 5 ounces of wine, OR
1 ½ ounces of 80 proof liquor, OR
1 ounce of 100 proof liquor.
"One drink" does NOT mean one glass, one bottle or one can unless they contain the above amounts.

B. Criminal penalties CAN BEGIN at blood alcohol level .05%

Impairment begins to be major at .05%
You may not feel affected at .05%
Your feelings don't matter
C. It takes at least one hour for your body to process each drink

If you weigh 100 pounds, 1 ¼ drinks in one hour will make you .05%
If you weigh 160 pounds, 2 drinks in one hour will make you .05%
If you weigh 240 pounds, 3 drinks in one hour will make you .05%

6.4ozs of wine

And that's at 12-15% alcohol so there's even more room for a range. I posted earlier that I had never seen the woman or knew her body type/frame size - but according to your post, 100 pounds, with 1.25 4-5 oz glasses of wine, you'd be at 0.05%

And no, it didn't have to Rove, was simply speculating. But it does seem odd to me that a person would have such a big alcohol problem to be weaving all over the road so badly as to prompt several other motorists to phone in the HP at 2:00 in the afternoon and yet have the length and depth of a successful enough career to have gotten to the level of a State Supreme court judge - and a public enough career that she was constantly surrounded by people, yet they either didn't notice habitual drunkenness or the attending rumors never spread far enough to hinder her promotions?

Yes, I'm assuming that a person in this case would have an ongoing problem with alcohol - it could certainly turn out to be the case that up until that day she was a complete tea-totaler - maybe that's why she was so influenced in the middle of the day.

61. Perhaps you should read more info on the case....
They have shown the video from the HP AFTER they had talked to her and she had illegally driven away from them. She is a hazard. There were 6 different cell phone calls about here driving. She was unsteady on her feet and slurring her words on the video. Then, she blew a .0218!! in the field Breathalyzer. That is HUGE! Not a glass of wine, more like 7 martinis in rapid succession. This was not an oversight during lunch, this was power drinking.

20. I love it, we have a DUI yellow shaming license plate law in Ohio.
On the first offense you have to put a yellow tag on every car you own, including your wifes and all work vehicles you drive. I am waiting for the day half the cars on the street have yellow tags. That will mark the end of the pendulum swing and the beginning of the return to sanity concerning DUI laws. Otherwise we are headed to a .05 or even a .02 legal limit.

Her arrest came just days after the conclusion of a long-running court battle over an unsuccessful attempt by business groups to unseat her in 2000. On Friday, the Ohio Chamber of Commerce was forced to disclose who contributed to the advertising campaign.

Faced with $25,000 in daily fines, the chamber complied with a court order by providing a list of 383 donors who gave $4.2 million to a chamber organization that raised money to defeat Resnick.

Business groups dislike Resnick because of votes she cast that went against the insurance industry and companies trying to limit personal injury lawsuits.

The campaign included a television ad showing a female justice changing a vote after bags of money are dumped on her desk.

Since Republicans regained control of the court in 2003, justices have made a handful of rulings that businesses say are more favorable to their interests.

the last thing prominent dems need to be doing these days is pushing the law. If she was drinking, it would have been wisest to leave the driving to someone else, even if she was under the limit.

Lets face facts...Democrats have every reason to be paranoid now, because there's a rethug ready to pounce on each and every one. And these unscrupulous bastards don't care if they have to fabricate misdeeds to destroy democracy in America. Caring about people is not part of their agenda.

29. Why would the good Judge not take the breath test if she was under the
limit? After all, that would be admissible in court. I am sure she would have known this, unless she was DRUNK. These same judges take your license for a year when you refuse the test under the assumption that no innocent person would refuse the chance to prove their innocence.

I couldn't say for certain.

While I'm inclined to agree with you, there's always the possibility that she was unsure whether she was above the legal limit, or that she felt she was entrapped somehow.

If she wasn't sure, she shouldn't have driven.

Justice Alice Robie Resnick is the fourth woman elected to statewide office in Ohio and the second woman elected to the Supreme Court of Ohio. She was first elected to the Supreme Court in 1988, and was re-elected in 1994. Justice Resnick was the founder and co-chair of the Ohio State Bar Association/Supreme Court of Ohio Joint Task Force on Gender Fairness. This task force addressed issues such as gender bias in the courts; lawyer and workplace life styles; gender bias education; and gender issues in domestic relations cases. A Final Report was issued in May 1995. From 1998 to the present time, Justice Resnick has chaired the Ohio Women’s Legal Assistance and Education Coalition. Through its three committees, the Gender Fairness Implementation Committee, the Legal Assistance and Education Centers Committee, and the Legal Rights Handbook Committee, the coalition seeks to assist and inform women in Ohio regarding their legal rights.

Justice Resnick was born on August 21, 1939 in Erie, Pennsylvania. She resides in Toledo with her husband, Judge Melvin L. Resnick, who sits on the Ohio Sixth District Court of Appeals. She has three step-children, six step-grandchildren, and three dogs, one of which is a rescued greyhound.

37. This is a political arrest.
No republican justice would be picked up and charged for drunk driving. Our local rep resigned under a cloud of illegal, self-serving transactions, but there has never been a charge; not even a story in the paper. I know the paper's crime reporter and he can't do the story because of political pressure. If you're white and politically (rethug) connected, the rule of law does not apply.

Her judicial views do not, and should not, play any role in this, either one way or the other. If she's guilty, she's guilty. That's it.

44. RESNICK’S DUI CASE Justice ignored police orders
Before Supreme Court Justice Alice Robie Resnick was charged with operating a motor vehicle under the influence Monday, she drove away from state troopers and local police who asked her to submit to field sobriety tests.

When she ultimately agreed to a portable breath test — which is not admissible as evidence in court — it registered 0.216, more than twice Ohio’s legal limit.

At least six motorists called 911 about a gold Jeep Grand Cherokee weaving along southbound I-75 about 2 p.m., nearly sideswiping one vehicle. Resnick’s state-owned 2001 Jeep Grand Cherokee matches that description.

Resnick pleaded no contest and was convicted in July of failure to control and weaving in Toledo after the gold 2002 Cadillac DeVille she was driving ran into the back of another vehicle at a traffic light. Public records also show she has been involved in two other accidents since 1998 in Lucas County, although she apparently was not cited in either.

47. Maybe she now gets a view from the other side that she didn't have before.
"In 1996, for example, she wrote the majority opinion in a case that said police do not have to tell people suspected of drunken driving that they have the right to a second, independent blood-alcohol test."

52. Showed the video of her weaving all over the road on our local news
and then getting out of the car slurring her words. She said something like"I thought the State Troopers were suppose to let around a Supreme Court Justice" "I my god this is so embarrassing".

54. The Ohio Supreme Court? So she's one of the judges
who tossed out Arnebeck's suit?

I wonder who helped her get the previous DUI cases thrown out. A little political payback, perhaps--or the typical Bush modus operandi: find someone with something to hide so you can control them, then get them appointed to key positions.

57. Ohio Supreme Court Justice Arrested for DUI
The only Democrat on Ohio's Supreme Court was arrested for DUI. This sucks, she's pretty good.

59. You don't blow a .0218 from a roofie. You have to drink like a fish for
that kind of a reading. I'm not talking a few drinks with LUNCH. I am talking about 6-7 very strong martini's. There is no way in hell a person gets that drunk by 2PM and doesn't try.
