Army Officer Acquitted of Raping Soldier in Her Barracks Room

FORT RUCKER, Ala. (AP) - An Army officer was acquitted by a military judge Wednesday of raping a soldier in her barracks room, a claim the defense said she concocted to keep from being sent to Iraq.


First Lt. Mike Hall, 35, of Nashville, Tenn., was also acquitted on an adultery charge but convicted of having sex without informing his partner that he had genital herpes.

Hall had testified in his court-martial that a night of dancing, flirting and kissing with 1st Lt. Jennifer Dyer, 26, last August led to consensual sex, not rape as she alleged.

He said Dyer invited him into her room at Camp Shelby in Mississippi and that, during two short episodes of intercourse, he stopped both times when she said "No."

2. I'm not going to comment on the case, but the headline is kinda iffy for
me. They were both officers, and I think they should have both been named officers in the title of the article (I'm not talking about the thread posted here, because it mirrors the article title).

An officer raping a soldier insinuates that the soldier is enlisted, which she isn't, she's also an officer. Suggesting that she's a soldier does the rhetorical equivalent of Time magazine making OJ's Mugshot much darker than it really was.

Again, I have no comment on the case itself, but I think it's misleading to suggest the line between officer and enlisted was also broken.

3. This just out-the judgement! (In my imagination)
She has to go to Iraq because it was ruled consensual and he gets to stay in the USA because he was convicted of having sex without letting her know about his herpes!

So they had sex, she said no and he stopped? Both times? Um, how long is a "no" good for these days?

4. If I am not mistaken she is out of the military. There is alot
more to this story. She refused to return to base etc. I believe she wished to be discharged.

I do not see how he was not convicted of adultry for one thing. It seems he obviously commited adultry and the last time I checked you could not force someone to have sex with you if they said no.

Last time I checked forcing someone to have sex with you if they said no was rape. What do you mean????

Got it, your terminology stumped me for a moment. In my opinion, you can have forced sex. Rape is violence masquarading as sex. Forced sex=rape to me. Putting external sexualy parts together, forced or willing seems like sex to me, but I get your point too.
