"Preparations are already well under way within the White House to fill an expected vacancy on the Supreme Court, with at least one conservative legal organization having submitted its recommendations on who should sit on the nation's top court."

"The Christian Legal Society, he said, has 'made it known to the White House who we believe are our top three most qualified candidates consistent with the president's stated views that he is looking for judges who faithfully interpret the law, not legislate from the bench.'

"Judge Michael W. McConnell on the 10th U.S. Circuit Court of Appeals is top of the list for CLS, a 42-year-old, 3,400-member nonprofit group that says its mission is 'to do justice with the love of God.'"

NARAL prepared a briefing on McConnell when he was nominated for the appeals court. Replete with McConnell quotes it is chilling and should put any DUer concerned about reproductive rights and the separation of church and state on maximum alert.

3. The WH usually gets a substantial notice
when there is a pending resignation. This is what is spurring all of this right now. They already know in advance which justice(s) is/are resigning. It is a now or never scenario due to the misery index and the unexpected polical capital already spent and bush isn't even 6 months into his term.

Phase I: The test cases to support unilateral political power and potential political damage. Phase II: Bring in the most radical wingnut we can find to support our causes, most importantly the evisceration of Roe V. Wade. Phase III: More upcoming resignations -check age and health - make it a lasting legacy for years to come. Phase IV: All things are appealable to our republican court and they have the most activist judges on the bush side. Phase V: rename country or what's left of it after what makes a democracy is irradicated by an evangelical right-wing activist court.

The furor over the Nuclear Option is because they may have more than one opening and need to plan for at least two more. They are seriously vetting to ensure no more David Souters get on the Court.
