Breaking - Texas grand jury indicts DeLay on charge of money laundering

Texas grand jury indicts DeLay on new charge
House majority leader charged with money laundering


BREAKING NEWS

Updated: 6:10 p.m. ET Oct. 3, 2005
AUSTIN, Texas - A Texas grand jury indicted U.S. Rep. Tom DeLay on a new charge of money laundering Monday, less than a week after another grand jury leveled a conspiracy charge that forced DeLay to temporarily step down as House majority leader.

Both indictments accuse DeLay and two political associates of conspiring to get around a state ban on corporate campaign contributions by funneling the money through a political action committee to the Republican National Committee in Washington.

The RNC then sent back like amounts to distribute to Texas candidates in 2002, the indictment alleges.

Additional info - "The new indictment came hours after DeLay's attorneys filed a request to dismiss the case. That request argued that the conspiracy charge was based on a law that was not effective until 2003, the year after the alleged money transfers.

The judge who will preside in DeLay's case was out of the country on vacation and could not rule on the request. Other state district judges declined to rule on the request in his place, said Colleen Davis, a law clerk to Austin attorney Bill White, also represents DeLay.

For money laundering federal money. 2 different allegations from different grand jurys. The conspiracy charge isn't tough enough so they went for money laundering, too.

The lawyer says there is no conspiracy, and so this covers the screw-up for calling for conspiracy charges. Conspiracy isn't a crime, apparently in Texas.

It appears the conspiracy charge may not stick
From that article:

A criminal conspiracy charge against U.S. Rep. Tom DeLay should be dismissed because conspiracy laws did not apply to the state election code during the 2002 election, DeLay's lawyers argued in a brief filed today. The filing represents an attempt at a quick knockout of the case against DeLay, who was indicted last week by a Travis County grand jury. The term of the grand jury ended last week and a deadline to indict DeLay might have expired since then.

DeLay's lawyer Dick DeGuerin said "rumors are flying" that prosecutors were trying to find a sitting grand jury, who hadn't heard any of the DeLay case, to return a new money-laundering indictment. In a letter to Travis County District Attorney Ronnie Earle, DeGuerin said DeLay is withdrawing his waiver of the statute of limitations to investigate him. Last month DeLay signed that waiver in an attempt to head off an indictment.

says a Texas criminal law expert:

"No effect on the conspiracy charge?
George Dix, a professor at the University of Texas law school who is an expert in criminal law and procedure, said he doesn't believe changes made to the Texas election code by the 2003 legislature have any effect on the conspiracy charge.

The penal code's conspiracy charge allows for the charge if the defendants allegedly conspired to commit any felony, including an election code felony.

Just because the election code was “silent” on the penal code provision until 2003, it doesn't mean it wasn't a valid charge before 2003, Dix said.

“To me it just says, ‘We really mean what we said implicitly before,’” Dix said."

DeLay's lawyer Dick DeGuerin said "rumors are flying" that prosecutors were trying to find a sitting grand jury, who hadn't heard any of the DeLay case, to return a new money-laundering indictment. In a letter to Travis County District Attorney Ronnie Earle, DeGuerin said DeLay is withdrawing his waiver of the statute of limitations to investigate him. Last month DeLay signed that waiver in an attempt to head off an indictment.

In the brief, DeGuerin argued that the conspiracy statute did not apply to the election code until the Legislature amended the law, effective Sept. 1, 2003, after the 2002 election.

In his letter, DeGuerin noted that DeLay was forced by Republican Party rules to step down as U.S. House Majority Leader while he fought the charges.

"Since the indictment charges no offense, and since you have professed not to be politically motivated in bringing this indictment, I request that you immediately agree to dismiss this indictment so that the political consequences can be reversed," DeGuerin wrote.

The Bush committee records show, too, that Bush’s operation paid for the hotel where the Republican protesters celebrated after the Miami riot at a Thanksgiving Day party. At the party, the activists received thank-you phone calls from Bush and Cheney, and were serenaded by crooner Wayne Newton, singing “Danke Schoen,” German for thank-you very much.

The IRS records show that the Bush recount committee paid $35,501.52 to the Hyatt Regency Pier 66 in Fort Lauderdale, Fla., where the party was held.

87. Anderson Cooper reporting that the original charge of conspiracy
probably would have been thrown out because the crime happened before the conspiracy charge was added to the law. This was a second grand jury, different make up from the other, that heard the facts and brought these charges. These offenses were covered by the law in 2002, when the acts took place. Conspiracy was not added to the law until 2003.

WASHINGTON (Reuters) - A Texas grand jury has indicted U.S. Rep.
Tom DeLay on a charge of money laundering, the second indictment against the Texan who stepped aside last week as the second-ranking Republican in the U.S. House of Representatives.

Delay's office confirmed the indictment on Monday. It released a statement in which DeLay accused Travis County, Texas, District Attorney Ronnie Earle of "prosecutorial abuse" and denied all charges.

"He is trying to pull the legal equivalent of a 'do-over' since he knows very well that the charges he brought against me last week are totally manufactured and illegitimate. This is an abomination of justice," DeLay said.

A Travis County grand jury indicted DeLay last Wednesday on a felony conspiracy charge, and he temporarily gave up his post as House Majority Leader.

Delay is a good start, but it's when all the other names start turning up as a part of the investigation, that we're really gonna hit the motherlode.
