WaPo/AP: Top Senate Democrat Concerned About Alito
By JESSE J. HOLLAND
The Associated Press
Wednesday, November 16, 2005; 7:18 PM

WASHINGTON -- Democrats said on Wednesday that Samuel Alito's confirmation was not guaranteed as senators kept the focus on a 20-year-old document in which the Supreme Court nominee asserted that the Constitution "does not protect a right to an abortion."

"Anyone who thinks that this nomination is a foregone conclusion is sadly mistaken," said New York Sen. Charles Schumer, one of several Democrats who used Senate speeches to criticize Alito.

"There are too many questions still to be answered, too many doubts still to be alleviated to say that this nomination is a slam dunk," Schumer said.

12. So true
with the moderate Repubs not wanting anything to do with him and his itty bitty coattails, we have noting to fear but fear itself.

11. Apparently Feinstein said she'd not vote for him either---
based on her conversations with him so far.

Good to see you posting Patsy!

Thanks! The one thing we can't afford is a packed court, corporate-friendly and civil rights shy.

16. You're right, but I'm not hopeful that this can be avoided...
now that the Chief Justice is in place.
And will the dems continue to battle for us--like they seem to be doing lately?
There are so many battlefronts these days, not even counting the mess in Iraq.

19. It *is* hard to keep track.
I've often suggested some sort of running scorecard or program of the current battles/scandals.

It seems to me that the Dems are energized by the low poll numbers and the surveys showing growing distrust. Like in Parliament, it's almost as if the Dems see themselves as (gasp!) an opposition party for the first time in years.

I think they will continue. What do they have to lose? We want the House in 2006 so badly we can taste it. The gloves are off, they have found a spine.

I'm not thrilled with Roberts, but I didn't get a huge woogie feeling about him. There was nowhere to go after Rehnquist but latteral or up, so, no harm, no foul. At least he argues logically. Even if I don't agree with him, I understand the argument.

This is the nomination to fight, this is the fight we must win.

17. voting "no" is the same as voting "yes"
because if this guy comes up for a vote AT ALL, then he wins and gets on the court

FALITOBUSTER!!!!

15. There ARE too many questions to be answered
And remember, Alito has lied under oath before, when he said he'd recuse himself from any cases involving Fidelity and then participated in cases in which Fidelity was a party anyway.

A man who will lie under oath should be in front of the bench, not sitting on it.

18. Either he lied to get a promotion with Reagan or he's lying now. He lied
about whether he'd recuse himself in cases involving Vanguard when he was confirmed in 1990.

He is out of the mainstream with respect to his neanderthal right-wing-activist views where he has repeatedly demonstrated his eagerness to ignore decades of precedents to achieve his ends-justifies-means results on (1) affirmative action, (2) congressional authority to regulate corporate corruption, (3) a women's sovereignty over their own wombs, (4) gender discrimination, (5) gun control, (6) racial discrimination, (7) the Family Medical Leave Act, (8) prisoner's fair treatment, (9) judges being allowed to decide cases in favor of corporations which they are personally heavily invested in, etc., etc., etc.

Even if Alito could explain his way out of these judicial activist rulings, why would anyone believe his bullshit excuses because he has a known pattern of lying to get job promotions.

STOP ALITO BEFORE HE BORKS AGAIN!

20. We need to push the activist judge meme.
And, you're right, let's not forget the conflict of interests and corporatism.

22. And an agenda.
There's no way he's gonna look at each case objectively. He has a plan to change the laws to match his opinions; he's part of the problem.
