During deliberations in the 10-week federal trial of a Lodi man convicted of terrorism, the jury foreman contacted an alternate juror about a member of the jury who was frustrating the foreman.
The seemingly inappropriate conduct in the trial of Hamid Hayat came to light Wednesday when U.S. District Judge Garland E. Burrell Jr. issued a notice of the contact.
The judge's courtroom deputy, Shani Furstenau, received a message on her voice mail from alternate juror Marta Watanabe that she was contacted April 20 by jury foreman Joseph Cote, who "asked her a question about Arcelia Lopez," according to Burrell's one-sentence notice.
It was not clear Wednesday whether Burrell intends to investigate Cote's conduct.
