Court limits in-car FBI spying

An appeals court this week put the brakes on an FBI surveillance technique that turns an automobile driver's on-board vehicle navigation system into a covert eavesdropping device, after finding that the spying effectively disables the system's emergency and roadside assistance features.

2. New digital phones
can, in fact be used the same way.

If you don't want to be recorded, don't have your phone with you. According to my friend who works with DHS, SS, and FBI, the phones can be turned on remotely without the display. In other words, it doesn't appear to be on.

I asked about taking the battery off, but I am not sure if it can still be fired up with an internal battery.

3. Without the battery pack the phone can't transmit
The battery used to keep memory, if there is one, wouldn't last for any usable length of time.

My friend told me he was watching one of the tv shows reviewing autos and during one of the road tests of the vehicle doing high speed turn, the sensor for vehicle flipping over triggered and the driver got a call from onstar DURING the slalom test.
