Cheney Asks Judge to Toss CIA Leak Suit

WASHINGTON - Vice President Dick Cheney asked a federal judge Tuesday to dismiss a lawsuit brought against him by a former CIA operative who says the White House leaked her identity to the press.

Cheney's attorneys criticized the lawsuit in court papers, saying it invented constitutional rights, intruded on national security discussions and came two years after the statute of limitations had expired.

"Plaintiffs invite the judicial branch to permit intrusive discovery into those communications and to discern which among them might be, as a matter of tort law, wrongful and which not," Cheney's attorneys wrote. "Such an inquiry cannot be squared with basic separation of powers principles."

The Justice Department also weighed in on behalf of Cheney and other Bush administration officials including presidential adviser Karl Rove. In briefs, the agency said government officials are shielded from civil lawsuits and that Wilson has not shown that a constitutional right was violated.

3. Yup, Bush & Cheney can torture, kill, spy on, blackmail, place in danger,
out, rob, abuse, detain without trial, slander and destroy the career of anyone they damn please, and neither we, the people, nor the courts, nor the Congress, should be able to do anything about, huh?

Well, I hope Cheney learns a thing or two about the "balance of powers" sometime soon. And about hubris. Some part of the legal/political system that he & cabal have tried to destroy may surprise him, one of these days, and start holding them accountable.

I am not without hope of that happening, although I think the basic system of accountability--transparent vote counting--will likely need to be fixed first.

7. Where are the R's for this? They are using the Dept. of Justice as leverage against a civil suit
which has a tremendous amount of merit, and nothing from DU'ers to keep this front and center?

THE PEOPLE think that the strangle hold Cheney had on the evidence against him was so complete as to necessitate pursuing beyond the statute of limitations.

25. You need to brush up on the law - the Jones case went forward
because it was conduct PRIOR to Clinton taking office. Agnew comparisons are not relevant since they were criminal cases, not civil. I predict suit against Cheney will be tossed.

Agnew's downfall began in the summer of 1973, when he was investigated in connection with accusations of extortion, bribery, and income-tax violations relating chiefly to his tenure as governor of Maryland. Faced with federal indictments, Agnew fought the charges, arguing that the allegations were false, that a sitting vice president could not be indicted, and that the only way he could be removed from office was by impeachment. After the solicitor general released a brief asserting that sitting vice presidents could be indicted, Agnew launched an attack on the administration and vowed not to resign. With Nixon in danger of impeachment for his role in the Watergate scandal, the administration sought to remove Agnew from the presidential line of succession, and secret plea-bargaining took place between Agnew's lawyers and a federal judge. Agnew resigned the vice presidency on October 10, 1973, and appeared in United States District Court in Baltimore on the same day to plead nolo contendere to a single federal count of failing to report on his income-tax return $29,500 in income that he had received in 1967, while governor of Maryland. Acknowledging that the plea amounted to a felony conviction, Agnew declared that he had resigned in the national interest. He was fined $10,000 and sentenced to three years of unsupervised probation.

This was a very serious intentional breach of national security.

Contraband nuclear material is the greatest threat to this country, as expounded by both Kerry and Bush in the debates. The Plame spy operation was our top operation against this stuff and our traitorous "leaders" compromised the spy operation for political gain!

There should have been republicans calling for impeachment but the republican party has become a completely lockstep corrupt entity. They are truly scoundrels.
