New York Times turns to Supreme Court

WASHINGTON - The New York Times asked the Supreme Court on Friday to block the government from reviewing the phone records of two reporters in a leak investigation about a terrorism-funding probe.

The case involved stories written in 2001 by Times reporters Judith Miller and Philip Shenon that revealed the government's plans to freeze the assets of two Islamic charities, the Holy Land Foundation and the Global Relief Foundation.

In a 2-1 decision, the 2nd U.S. Circuit Court of Appeals said federal prosecutors can see the phone records of Shenon and Miller. Miller retired from the Times a year ago.

The Times wants Justice Ruth Bader Ginsburg to block temporarily the government from going through the records so that the newspaper can prepare a petition arguing why the justices should step into the case. Ginsburg asked the Justice Department for a response.

that the FBI is going to raid their offices is not whistleblowing.

4. I should clarify...
my comments were geared, or rather intended to be, towards the attitude put forth by the bush administration of seeking out genuine whistleblowers and others who reveal illegal gov't programs through seeking protected source information from journalists, etc.

I should have been clear. Rather, I should have read the entire article, thought more, and posted more than a sentence.

2. Uh, actually, that's not the case
This is one of the cases Patrick Fitzgerald has been working on. Judith Miller is accused of tipping off the charities involved that the FBI was about to stage a raid on their offices. She greatly endangered the law enforcement personnel participating in the efforts to determine whether or not the "charities" were actually a front to launder terrorist funds.

Judy Miller is not a "whistleblower" under any stretch of the imagination.
