Prosecutor Recommends No Charges In Allen Incident
http://www.timesdispatch.com/servlet/Satellite?pagename=RTD/MGArticle/RTD_BasicArticle&c=MGArticle&cid=1149191916333

A Charlottesville city prosecutor is recommending that no charges be brought against any participants in the scuffle Oct. 31 between a U.Va. law student and backers of Sen. George Allen....

University of Virginia law student Mike Stark filed an assault complaint after being thrown to the floor by Allen supporters after he tried to ask Allen whether he had ever spat at his first wife.

5. As long as you don't seek to hurt them
"The balance of evidence reflects that no one sought to hurt anyone," said city Commonwealth's Attorney Dave Chapman.

3. Hmmm...
"The balance of evidence reflects that no one sought to hurt anyone," said city Commonwealth's Attorney Dave Chapman."

So, what was the point of the supporters throwing Stark to the ground? Intimidation?

The article doesn't state whether Stark was in agreement with this.

4. Your hypothesis is a pretty good one.
Roughing the guy up for the purpose of discouraging inconvenient political activity via intimidation. That's not supposed to be legal.

Then again, not every illegal act is prosecuted. I just wish the reason sounded a little less like kissing Allen's butt.

6. Legal Definition of Battery
battery n. the actual intentional striking of someone, with intent to harm, or in a "rude and insolent manner" even if the injury is slight. Negligent or careless unintentional contact is not battery no matter how great the harm. Battery is a crime and also the basis for a lawsuit as a civil wrong if there is damage. It is often coupled with "assault" (which does not require actual touching) in "assault and battery." (See: assault>

http://legal-dictionary.thefreedictionary.com/battery

A crime consisting of physical contact that is intended to harm someone. Unintentional harmful contact is not battery, no mater how careless the behavior or how severe the injury. A fist fight is a common battery; being hit by a wild pitch in a baseball game is not.

Start the Festivitudes in Civil Court!!

Even if Allen has any governmental immunity, his agents, servants and/or employees (in this case, goons) are still liable. Fun!!
