Airman's Death In Iraq Ruled A Homicide

The death of Airman 1st Class Carl J. Ware, 22, at Camp Bucca in Iraq (7/1/06), has been ruled a homicide, The Camden (N.J.) Courier Post reported.

Fellow Airman 1st Class Kyle J. Dalton, 21, is charged with murder, failure to obey regulations and assault in the shooting, and in another incident in which he allegedly drew his weapon on Ware and another airman.

Both airmen had been in Iraq with the 886th Expeditionary Security Forces Squadron for only a month when the shooting occurred. Authorities originally thought it was an accident, the newspaper said.

In two weeks, an airman will face a court-martial on charges he murdered former Smyrna resident and fellow airman Carl Ware while they were deployed in Iraq. Airman 1st Class Kyle J. Dalton, like Ware a member of the 15th Security Forces Squadron at Hickam Air Force Base in Hawaii, faces charges of murder, assault, and wrongfully drawing or aiming a firearm.

Ware, 22, died after he was shot with a 9 mm handgun in the summer. Military officials originally said it was an accidental, noncombat-related death that occurred when another soldier’s pistol went off as he was cleaning it.

Ware’s parents, Carl and Rosalie Ware of Dinuba, Calif., said the Air Force told them in November that it was time “to stop referring to Carl’s death as an accident.” Charges were filed Nov. 30, and Dalton had an Article 32 hearing -- roughly equivalent to a civilian grand jury proceeding -- Dec. 20. Central Command has refused to release summaries of the statements made by witnesses at the hearing.
