Judge To Rule Monday on Teen Oral Sex Case

An appeals court judge says he'll make a decision by Monday in the case of a Georgia man who was sentenced to 10 years in prison for having consensual oral sex with a 15-year-old when he was two years older than she was.

In a hearing today, a lawyer for Genarlow Wilson asked the judge to throw out the aggravated child molestation sentence against his client, saying it's grossly unfair.

The defense attorney noted that state lawmakers were trying to target sex offenders who preyed on children -- and that they have since passed a law to close a loophole that led to Wilson's sentence.

However, a prosecutor argued the new law can't be applied retroactively.

3. According to Bill Clinton and Newt Gingrich, oral sex is not sex at all. I believed Gingrich studied

matter from all different angles, and decided it did not qualify as sex, or adultery. Bill Clinton contended that it didn't fit the definition of sex in the legal proceedings up to his impeachment.

4. IIRC, a survey was taken several years ago, many teenagers also believe oral sex is not "sex."

But this particular case is so ludicrous it would be laughable if not for the seriousness of this young man's situation.

Consensual sex between a 17 year old and a 15 year old ought to come within the scope of such a provision.

If Wilson had had sexual intercourse with the 15-year-old he would have fallen under Georgia's "Romeo and Juliet" exception. But under the law in 2003, oral sex between teens constituted aggravated child molestation and carried a mandatory sentence."

This is absurd on so many grounds.

Think about it if every 17 year old teen who dated a 15 or 16 year old female were arrested and prosectued for having oral sex the would have entire cities that were nothing but jails...

And why wouldn't the new law apply retroactively? If it doesn't then retry the case because the law was written so poorly.
