Bush National Labor Relations Board appointee Peter Kirsanow steps down

Attorney Peter Kirsanow has left the National Labor Relations Board to return to private practice at the Benesch Friedlander Coplan & Aronoff law firm in Cleveland.

President Bush appointed Kirsanow to serve on the NLRB, where he was a conservative voice for the past two years. Kirsanow was a recess appointment at the NLRB for an unexpired term that ended Dec. 31.

During that time, he was involved in several significant decisions, including the Dana/Metalydyne case dealing with "card check" -- a process by which an employer can recognize a union when a majority of employees sign union-affiliation cards.

The board curbed the organizing method by ruling that once a union is certified through card check, employers must notify employees that if 30 percent of them sign a petition saying they don't want a union, an election must be held -- even though a majority of the workers already signed cards saying they wanted a union.
