NLRB seeks injunction for Massey to rehire union miners

Massey Energy should rehire up to 85 United Mine Workers members at the former Cannelton Coal operation while the company appeals a judge's decision that it wrongly refused to hire longtime union miners, the National Labor Relations Board says.

NLRB lawyers filed papers in U.S. District Court in Charleston today, seeking a federal court ruling to force Massey to rehire the UMW members at its Mammoth Coal complex.

Agency lawyers asked for an injunction to require the company to recognize the UMW as the bargaining representative for all workers at the mine, implement the terms and conditions of the 2002 national coal contract and begin negotiating a new agreement.

The NLRB court action comes after Massey appealed an administrative law judge's ruling that the company should rehire the union miners.
