Feds say immigration case in El Paso wrongly dropped

NEW ORLEANS (AP) - A prosecutor today told an appeals court that a judge in El Paso wrongly dropped immigration fraud charges against an anti-Castro militant.

Prosecutors are appealing the dismissal of charges that Luis Posada Carriles made false statements in his bid to become a naturalized U.S. citizen.

Judge Kathleen Cardone last year ruled authorities engaged in deceit by using a naturalization interview to build a criminal case against Posada.

The Cuban-born citizen of Venezuela is wanted for alleged involvement in a deadly 1976 jet bombing. He denies the allegations.
