Secretary of Senate rejects Burris, aide says

Secretary of the Senate Nancy Erickson has rejected Roland Burris' appointment to the Senate, an aide to the secretary told CNN.

Erickson rejected Burris' appointment because his certificate of appointment was missing the signature of Illinois Secretary of State Jesse White, the aide said Monday.

Rule 2 of the Standing Rules of the Senate states that the secretary of state must sign the certificate of election along with the governor.

White has declined to sign the certificate, siding with some Senate Democrats who say Burris should not be seated because of the cloud over Illinois Gov. Rod Blagojevich, who is accused of trying to sell President-elect Barack Obama's Senate seat.

2. Burris is lying through his teeth by saying he didn't expect all of this.
Plus the fact that he's trying to make it sound like there is a racial issue, makes him less honorable in my book. And that is all on top of the fact that this opportunist actually *accepted* the nomination from Blago with all of this going on.

4. that is the unconscionable part...
I had empathy for Burris and was conflicted as to whether or not he was being treated appropriately... Just another exploitative opportunist, it would now appear..

3. Kabuki theater.The Senate concedes Burris did nothing wrong. And, even as to Blago,
even Pub talking heads are conceding that what he did goes on all the time as to Senate appointments. Blago was just less graceful about it than most. Not that I am defending Blago or anyone who did what Blago tried to do. But, the Senate concedes that Burris Burris is not an "evildoer." Well, if Burris did nothing wrong, the pracess, as to his appointment is fine.

5. If the law say the SoS shall affix his seal. If the context of shall forms an order.
The ommission of the seal by the SoS constitutes a crime and the Governor should have the SoS arrested. If there is a refusal to arrest the SoS for the crime. That Constitutes acrime and a paramilitary rebellion to which the Governor can declare martial law and call out the national guard to supress that rebellion. Until he has been impeached. He is the Governor with all right and power intact.

6. What is the legal justification for
Illinois Secretary of State Jesse White refusing to sign the certificate of appointment? Like it or not , Blagojevich is the legally elected Governor of Illinois and until the time he is removed from office, has the right to make this appointment.

7. May be grounds to require Sec of State to sign appointment or be dismissed from office
for failure to perform the duties of the SOS's office. Believe these officials should tread lightly on this one and seek court guidance themselves before they refuse to perform an official function.
