Birther Taitz Decries 'Political Lynching' In New Filing Against Judge's $20K Fine
Source: Talking Points Memo

In a colorful eight-page filing, Birther attorney Orly Taitz declares that she will appeal a federal judge's $20,000 fine, which she was ordered to pay within 30 days last week.

The filing with the US District Court for the Middle District of Georgia is dated Monday and was posted last night. Read the whole thing here.

Taitz also claims that she hired a private investigator who found "39 different social security numbers used by Mr. Obama" including numbers with links to Judge Clay Land's own district. This, Taitz says, is reason she should be granted further discovery.

She told TPMmuckraker last week that she had no intention to pay the $20,000 fine, which stemmed from frivolous filings in the Birther case of Taitz's former client, an Army captain.

she's representing herself -- not a client. So attorney or not she would be allowed to file on her own behalf (pro se).

6. Orly Taitz files comical notice of appeal

Somehow this must have looked like a good idea to the firm of Taitz, Lincoln. But how does a lawyer who has been fired by her client, a lawyer who then filed a Motion to Withdraw as attorney for that client, now file an appeal on behalf of that client?

On September 28, 2009, in Document #21, this Court granted counsel’s Motion to Withdraw as Attorney (Documents #19-20, 22). The undersigned, accordingly appeals only the conditions attached to that order granting her leave to withdraw as counsel for the Plaintiff.

If she can appeal her own motion, which was granted, on behalf of a client she doesn’t have, the law is a bigger ass than I thought. The condition attached to that Order was that she not break attorney-client privilege, as she had asked to do when withdrawing as attorney for Capt. Rhodes, who had already fired her in the famous Office Max Fax. In appealing her own sanctions, Dr. Orly Taitz, Esq. wants to blab her former client’s secrets, while appealing same sanctions in the name of her former client.

I once knew a lawyer who I somehow annoyed, even
though I was always nice to him personaly.
An unpredictable lot, lawyers, don't you find?

Anyway, if that counts for anything I'd be guessing the
order stands and the Fed Marshal may proceed with
collection in the absence of an order to the contrary
as soon as the date has passed.

Is that how you read it. No arrest and jail, just get the
money and bring it to ME! OK, maybe just the "Get the money!" part.

Of course, if she interferes with the Marshal collecting
the $20,000.... you know, confronts him and beats her tiny fists
upon his chest crying "Where's the birth certificate!" over
and over.... well then....

on top of a goldmine! Sure enough.

But this gets more and more bizarre.

Recap, Orly files a case. After expedited hearing requested by her
the judge dismisses, basically on grounds of abstention.

He also finds the case frivolous and warns against further
frivolous actions. The ruling and findings are well supported.
A skillful lawyer might still save the day, if they are very very
good and very very careful. But noooo, Orly is not that kind of lawyer.

She files a motion for reconsideration which is not only abusive
but does not even address the court's ruling. The court finds that
a motion for reconsideration which does not address
legal issues in the challenged ruling is itself frivolous,
and issues a show cause for sanctions of $10,000.

Orly responds to the show cause and provides an abusive answer
which ALSO manages to miss mentioning or addressing any issues
related to sanctions! OMG. She gets fined $20,000.

So now she generally appeals, bypassing normal procedure on some kind of
claim of bias, futility and peril (ironically true, just not in the way
she imaghines), and now claiming her original filing was not frivolous
and that she must be granted discovery to prove that? Hello? Does she now
know that Obama is no longer in this case?

She does state she is appealing all the adverse rulings... but she gives
no legal argument they are in error. Shotgun!

What is kinda bizarre is that her client has already fired her.
Well, anyway, I lost her back at the beginning.
Anyone care to explain the current motion?

32. Well, the current filing presents itself as a notice that she will appeal the $20K sanctions. But
for reasons known only to Orly, the filing manages not to suggest much reason for appeal, though it does manage to suggest that the judgev is somehow in cahoots with some identity-theft mastermind who has somehow become POTUS, leaving behind only a mysterious trail of dozens of false social security numbers :crazy:

As far as I can figure from pg 4

frivolous (and she wants, nay, demands discovery to prove this), that her motion for reconsideration (declared frivolous,
for which an osc was issued), and that her osc response (again frivolous, for which her fine was doubled) somehow had merit.

all this she now appeals (along with objecting to everything mean the judge said about her), all while claiming the judge is a
corrupt socialist sympathizer and scum sucking progressive in bed with Obama.

first, shouldn't she have done all that in her reconsideration motion , or at least in her OSC response?
AFAIK all she covered in the osc was the judge is a corrupt chicken plucker who is against her.

and second, now she finally mentions the abstention ruling (in passing). two motions too late...
god, didn't they teach her abstention in correspondence school?

You wonder if anyone who passed the CA bar (50% pass rate) could actually be such a bad lawyer, or perhaps she
just became unhinged when a black man was elected President. In any event there might be some
argument that could be made on behalf of her client, but these legal maneuvers demonstrate she has
no care about her client, this is HER mission not theirs, her arguments have zero merit, and all this
seems to accomplish is to play to the money machine back home.

(Perhaps She hopes the Supreme Court will pluck the case from the wilderness and rule to unseat Obama.)

I think we know what happens next.

As for Orly's "clients"... shudder.
